Sven Mislintat has been found not guilty of a conflict of interest during his time at Ajax.
The sporting director was cleared by the KPMG (Dutch financial auditors) over a deal for Borna Sosa from Stuttgart.
He is now likely to be named as Borussia Dortmund sporting director, returning to the Bundesliga side where he made his name as a head scout.
In a statement, Ajax said: “No formal conflict of interest has been identified regarding the transfer of Sosa. Nor have any conflicts of interest been identified with the other incoming transfers.
“Mislintat’s working method does raise questions, but there is no basis for liability.”
During Mislintat’s brief four-month stint in Amsterdam, his €100million window ended with the purchase of Sosa.
Both Mislintat and Sosa’s agent, AKA Global, were shareholders of the company Matchmetrics GmbH around the time of the transfer. However, this was not a problem, according to the KPMG.
Their statement read: “It has emerged that both Mislintat and Sosa’s agent, AKA Global, were shareholders in the company Matchmetrics GmbH at the time of the transfer. Mislintat reported his shareholding to Ajax upon joining.
“It was not reported that AKA Global was also a shareholder in Matchmetrics at that time, but that was not relevant at the time. However, it would have been up to Mislintat to report this in the context of Sosa’s later transfer.
“According to legal advice, Mislintat as titular director was not expressly obliged to do so, but as a good employee he should have been expected to do so.”
