Belgian Pro League wins DAZN case, broadcaster must keep showing matches and reimburse fees

The Belgian Pro League is celebrating a major win after broadcasters DAZN were told they must continue showing the remainder of this season’s matches.

DAZN had earlier halted payments to the Pro League, saying their deal hadn’t yielded results commensurate of their €84million per-year contract.

However, the CEPANI arbitration tribunal have now ruled in favour of the Pro League.

Not only must the streaming service continue to broadcast, it must also continue to pay as agreed in the TV contract.

It’s important to note that this is a temporary ruling, pending a more thorough investigation of the case.

A press release read: “The ruling means that DAZN must continue making payments as contractually agreed.

“Furthermore, DAZN must continue to produce and broadcast the matches and continue to negotiate with the telecom operators to conclude distribution agreements.”

Lorin Parys, CEO of the Pro League, said: “We are pleased that DAZN must honour its commitments regarding production, distribution, payment, and negotiations with telecom providers, among other things. The winners of this ruling are our fans, our clubs, and Belgian football as a whole.”

In response, DAZN said: “The decision of the CEPANI emergency arbitrator is confidential. DAZN cannot therefore comment on its content, as it wishes to comply with the procedural rules for CEPANI arbitrations.

“This does not prevent DAZN from confirming that, in accordance with the offer it made before the emergency arbitration, it will continue to produce and broadcast Pro League content until the end of this season. This decision guarantees continuity for the fans and the clubs, something DAZN has always advocated.

“It is important to emphasize that these precautionary measures taken by CEPANI, including interim payments, do not affect DAZN’s legal position in the ongoing dispute with the Pro League.

“DAZN remains confident that the CEPANI arbitration tribunal, which will be constituted in the coming weeks, will rule that the original agreement has been legally terminated.

“We made the promise that we will continue producing and broadcasting Pro League matches even before the Pro League decided to initiate an emergency arbitration procedure, and we will keep that promise. This ensures the necessary continuity for the fans and the clubs that DAZN has always advocated for.

“DAZN remains available and willing to conclude balanced agreements that guarantee the necessary stability within a viable commercial framework.”
